1. Overview

These Terms of Service (“Terms”) govern your access to and use of be-selfreliant.com and your purchase or use of products and services offered by Be Self-Reliant (“Be Self-Reliant,” “we,” “us,” or “our”).

Our online store is powered by Shopify.

By accessing the website, creating an account, placing an order, enrolling in a subscription, or otherwise using the Services, you agree to these Terms and the policies incorporated by reference, including our:

  • Privacy Policy;
  • Refund and Return Policy;
  • Shipping Policy;
  • Subscription and Cancellation Policy;
  • Consumer Health Data Privacy Policy, where applicable.

If you do not agree, do not use the Services.

2. Eligibility and Accounts

You must be at least 18 years old and legally capable of entering into a binding agreement to place an order.

You agree to provide information that is accurate, current, and complete.

You are responsible for:

  • protecting account credentials;
  • activity occurring through your account;
  • promptly updating billing, payment, shipping, and contact information;
  • notifying us of suspected unauthorized activity.

You may not transfer, sell, assign, share, or sublicense your customer account.

3. Product Information

We attempt to describe and display products accurately. However:

  • colors and appearance may vary according to screen settings;
  • packaging may be updated;
  • minor visual or production details may vary;
  • product availability may change;
  • photographs may show props or multiple units not included unless expressly stated.

The physical product label controls concerning:

  • ingredients;
  • serving size;
  • directions;
  • warnings;
  • allergen information;
  • net quantity;
  • safety information.

We may improve or modify packaging, suppliers, manufacturing details, or non-material product characteristics without prior notice.

Material formulation changes will be reflected in legally required labeling.

4. Dietary Supplement and Health Disclaimer

Be Self-Reliant products are intended to support general wellness.

Dietary supplements are not drugs and are not intended to diagnose, treat, cure, or prevent any disease.

Information on the website, packaging, physical books, digital materials, advertisements, emails, and Customer Care communications is provided for general educational and informational purposes. It is not medical advice, diagnosis, or treatment.

Daily Mullein Essentials is not represented as a replacement for:

  • professional medical care;
  • smoking-cessation treatment;
  • prescribed medication;
  • emergency care;
  • advice from a qualified healthcare professional.

Consult a qualified healthcare professional before using a dietary supplement if you:

  • take prescription or non-prescription medication;
  • have a medical condition;
  • have known allergies;
  • are pregnant or nursing;
  • are preparing for surgery;
  • are under medical supervision.

Use products only as directed on the physical label.

Discontinue use and seek appropriate professional advice if you experience an adverse reaction.

Individual experiences and results vary. We do not guarantee any specific health, respiratory, behavioral, or smoking-related result.

5. Orders and Acceptance

Placing an order constitutes an offer to purchase.

An automated order confirmation acknowledges receipt but does not necessarily constitute final acceptance.

A physical-product order is accepted when it is shipped. Digital content is accepted when access is delivered.

We may verify, decline, limit, or cancel an order for legitimate reasons, including:

  • suspected fraud;
  • payment failure;
  • inventory unavailability;
  • pricing or description error;
  • legal restriction;
  • unauthorized resale;
  • unusual order volume;
  • violation of these Terms.

If we cancel an order after payment, we will refund the amount charged to the original payment method.

We will not charge a corrected higher price without obtaining new authorization.

Purchases are intended for personal or household use and may not be commercially resold without written authorization.

6. Prices, Taxes, and Payment

Prices, offers, and promotions may change before an order is placed.

The price applicable to an order is the price displayed and authorized at checkout, subject to correction of an obvious error before fulfillment.

Shipping and applicable taxes may be charged as disclosed at checkout.

By submitting payment information, you represent that:

  • the information is accurate;
  • you are authorized to use the payment method;
  • the payment provider may authorize and process the transaction;
  • you will pay all properly disclosed amounts.

Charges may appear on your statement as: "Be SELF-RELIANT" or "SP Be SELF-RELIANT"

Payment information is processed by Shopify and payment-service providers. We do not generally receive complete card numbers.

7. Subscriptions and Automatic Renewal

Certain products are offered through automatically renewing subscriptions.

All Be Self-Reliant subscription plans currently renew every 30 days unless a different frequency is clearly displayed and accepted at checkout.

The quantity selected at checkout is the quantity that will:

  • be included in the initial shipment;
  • be included in each recurring shipment;
  • be charged every 30 days.

For example, selecting three bottles means that three bottles are included in the first shipment and three bottles are included in each subsequent 30-day renewal unless the subscription is changed or canceled.

By purchasing a subscription, you authorize us and our payment providers to charge the payment method on file for:

  • the initial purchase;
  • the selected recurring quantity;
  • the recurring price displayed at checkout;
  • applicable recurring shipping;
  • applicable taxes.

The subscription continues until canceled.

First-Shipment Promotional Items

A qualifying first shipment may include:

  • Flavored Toothpicks;
  • the Healthy Lungs, Healthy Life hardcover guidebook;
  • premium presentation packaging;
  • other gifts expressly displayed in the offer.

Unless expressly stated otherwise:

  • promotional gifts are included only with the first qualifying shipment;
  • promotional gifts do not renew;
  • hardcover guidebooks do not renew;
  • premium presentation boxes do not renew;
  • recurring shipments contain only the products and quantities identified as recurring at checkout.

Canceling a Subscription

You may cancel without a cancellation fee:

Cancel before the next billing date to avoid the next charge.

An online cancellation is effective when the cancellation is completed and confirmed.

An email cancellation request received before the next billing date will be treated according to the time it was received, not the time our team responds, provided that the request contains enough information to identify the subscription.

Cancellation stops future renewals. It does not automatically reverse or refund an order already charged, processed, or shipped.

Subscription Changes

Where available, you may:

  • change quantity;
  • skip a shipment;
  • reschedule a shipment;
  • update payment information;
  • change the shipping address;
  • pause or reactivate a subscription.

Changes must be completed before the next billing date and are effective only after confirmation.

Price Changes

We may change a subscription price only after providing any notice required by applicable law.

A price-change notice will explain:

  • the new price;
  • when it takes effect;
  • how to cancel before the change.

Failed Payments

If a recurring payment fails, we may:

  • retry the payment method;
  • request updated payment information;
  • suspend fulfillment;
  • cancel the subscription.

Subscription Notices

We provide subscription confirmations, cancellation confirmations, annual reminders, renewal notices, and price-change notices where required by law.

8. Promotional Gifts and Bundles

Promotional gifts and bundle discounts:

  • apply only to qualifying offers;
  • are subject to availability;
  • have no cash-redemption value;
  • cannot be independently refunded;
  • may be limited to one per customer, household, address, payment method, or promotion.

If a disclosed gift becomes unavailable before fulfillment, we may:

  • provide a substantially comparable item of equal or greater stated value;
  • allow cancellation of the affected order;
  • provide another remedy required by law.

Returns involving bundles and promotional gifts are governed by the Refund and Return Policy.

9. Shipping and Delivery

Shipping is governed by our Shipping Policy.

You are responsible for providing a complete and accurate delivery address.

Once an order enters fulfillment, cancellation or address changes may no longer be possible.

Carrier tracking, delivery photographs, GPS records, signatures, concierge receipts, and other delivery records may be used to verify shipment or delivery.

Delivery estimates are not guarantees.

10. Returns and Refunds

Returns and refunds are governed by our Refund and Return Policy.

For health, safety, tampering, and hygiene reasons, ingestible supplements and oral-use products are final sale once opened, used, partially consumed, or once the safety seal has been broken or removed.

Nothing in these Terms limits rights that cannot lawfully be excluded.

11. Product Safety and Adverse Events

Stop using a product and seek appropriate medical attention if you experience a serious or unexpected reaction.

For emergencies, contact emergency services or a qualified medical professional. Customer Care does not provide emergency medical assistance.

To report a product-safety concern or adverse event, contact: support@be-selfreliant.com

Provide, where available:

  • product name;
  • order number;
  • lot number;
  • date of use;
  • description of the event;
  • contact information for follow-up.

We may request additional information and may report qualifying events to regulators as required by law.

12. Physical and Digital Educational Content

The Healthy Lungs, Healthy Life guidebook and any digital guides, videos, downloads, or educational materials are provided for general educational purposes.

Purchase of digital content grants a limited, personal, non-exclusive, non-transferable, revocable license for non-commercial use.

You may not:

  • reproduce;
  • resell;
  • redistribute;
  • upload;
  • publish;
  • sublicense;
  • share paid access;
  • create unauthorized derivative works;
  • use the content commercially.

Purchasing a physical book transfers ownership of that copy, but does not transfer copyrights or commercial reproduction rights.

13. Intellectual Property

The Services and their contents, including:

  • trademarks;
  • logos;
  • product names;
  • packaging;
  • designs;
  • photographs;
  • illustrations;
  • copy;
  • books;
  • videos;
  • graphics;
  • software;
  • website layout;

are owned by or licensed to Be Self-Reliant and are protected by applicable intellectual-property laws.

No right or license is granted except as expressly stated in these Terms.

14. Reviews, Testimonials, and User Content

Any review, testimonial, photograph, video, or other content submitted by you must:

  • reflect your genuine experience;
  • be accurate and not misleading;
  • disclose any material incentive or relationship;
  • not impersonate another person;
  • not violate another person’s rights;
  • not contain unlawful, defamatory, or infringing material.

You grant us a non-exclusive, worldwide, royalty-free license to reproduce, format, publish, and display submitted content for operational and marketing purposes.

We may edit content for spelling, length, formatting, or clarity, but will not knowingly alter its material meaning.

Submission of a general review does not automatically authorize public use of private medical records or sensitive health information beyond the content you deliberately submitted for publication.

We may request separate written permission before using identifiable photographs, videos, health-related statements, or before-and-after content in paid advertising.

15. Promotions

Promotional terms displayed with a specific offer form part of these Terms.

Promotions may be:

  • time-limited;
  • quantity-limited;
  • restricted to new customers;
  • restricted by geography;
  • restricted to one use per customer or household;
  • unavailable with other discounts.

We may prevent promotion abuse or cancel orders obtained through fraud, automation, identity manipulation, or violation of promotional conditions.

16. Third-Party Tools and Links

The Services may use or link to third-party platforms, including Shopify, payment providers, carriers, social-media platforms, and subscription-management tools.

Third-party services are governed by their own terms and privacy practices.

We are not responsible for third-party websites or services outside our reasonable control.

17. Relationship With Shopify

Shopify provides the ecommerce technology used by our store.

Sales of Be Self-Reliant products are made by Be Self-Reliant, not by Shopify.

To the fullest extent permitted by law, Shopify is not responsible for the products, fulfillment, representations, customer support, or transactions between you and Be Self-Reliant.

18. Prohibited Uses

You may not use the Services to:

  • violate law;
  • commit fraud;
  • submit false information;
  • interfere with website security;
  • introduce malicious code;
  • scrape or harvest information without authorization;
  • infringe intellectual-property or privacy rights;
  • impersonate another person;
  • abuse promotions, returns, refunds, or chargebacks;
  • commercially resell products without authorization;
  • harass or threaten staff or other users;
  • interfere with another person’s use of the Services.

We may suspend or terminate access for violations.

19. Errors and Corrections

The Services may occasionally contain typographical, pricing, availability, shipping, or descriptive errors.

Before fulfillment, we may:

  • correct the error;
  • contact you for confirmation;
  • cancel the affected order and issue a refund.

We will not unilaterally charge a higher corrected price without your authorization.

20. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN “AS AVAILABLE” BASIS.

EXCEPT FOR EXPRESS WARRANTIES THAT CANNOT LAWFULLY BE EXCLUDED, WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT:

  • THE WEBSITE WILL ALWAYS BE UNINTERRUPTED OR ERROR-FREE;
  • EVERY CUSTOMER WILL EXPERIENCE THE SAME RESULT;
  • A PRODUCT WILL REPLACE MEDICAL TREATMENT;
  • EDUCATIONAL INFORMATION WILL BE SUITABLE FOR EVERY PERSON;
  • DELIVERY WILL OCCUR ON AN EXACT ESTIMATED DATE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

21. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BE SELF-RELIANT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR LOSS OF BUSINESS OPPORTUNITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM A PRODUCT, ORDER, OR TRANSACTION WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM.

These limitations do not apply where liability cannot legally be limited, including where applicable to:

  • fraud;
  • willful misconduct;
  • gross negligence;
  • death or personal injury;
  • mandatory consumer rights.

22. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Be Self-Reliant and its affiliates, officers, employees, contractors, and service providers from third-party claims, damages, losses, and reasonable expenses arising from:

  • your unlawful use of the Services;
  • your material violation of these Terms;
  • your misuse of a product;
  • your infringement of another party’s rights;
  • false or unlawful content submitted by you.

This section does not require a consumer to indemnify us for our own unlawful conduct.

23. Force Majeure

We are not liable for delay or failure caused by events reasonably outside our control, including:

  • natural disasters;
  • severe weather;
  • war;
  • terrorism;
  • labor disruption;
  • carrier interruption;
  • government action;
  • epidemic;
  • cyberattack;
  • supplier failure;
  • utility or platform outage.

This section does not remove any refund or cancellation right required by law.

24. Informal Dispute Resolution

Before filing arbitration or litigation, the party bringing a dispute must send written notice describing:

  • the claimant’s name and contact information;
  • the relevant order or account;
  • the factual basis of the dispute;
  • the requested resolution.

The parties will attempt in good faith to resolve the dispute for at least 30 days.

25. Arbitration Agreement and Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except for eligible small-claims matters, requests for public injunctive relief that cannot lawfully be arbitrated, or disputes that applicable law does not permit to be arbitrated, disputes arising from these Terms, the Services, a product, an order, or a subscription will be resolved through individual binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect.

The Federal Arbitration Act governs this arbitration agreement.

Arbitration may be conducted:

  • by written submission;
  • remotely;
  • by telephone or video;
  • in the county where the consumer resides where required.

Either party may bring an eligible individual claim in small-claims court.

YOU AND BE SELF-RELIANT AGREE THAT CLAIMS WILL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION, EXCEPT WHERE APPLICABLE LAW PROVIDES A NON-WAIVABLE RIGHT.

The arbitrator may award any individual remedy available in court but may not grant relief for persons who are not parties to the arbitration.

Arbitration Opt-Out

You may opt out of this arbitration agreement by emailing support@be-selfreliant.com within 30 days after first accepting these Terms.

Use the subject line:

Arbitration Opt-Out

Include:

  • full name;
  • email address;
  • mailing address;
  • order number, if available;
  • a clear statement that you opt out of arbitration.

Opting out will not affect your purchase or subscription.

If part of this arbitration section is unenforceable, the remaining enforceable portions will continue to apply, except where applicable law requires the entire arbitration agreement to be invalidated.

26. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the arbitration section.

Nothing in this section deprives a consumer of mandatory protections applicable in the consumer’s state of residence.

A dispute not subject to arbitration will be brought in a court with lawful jurisdiction located in Wyoming, unless applicable law requires another venue.

27. Severability

If a provision is found unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.

28. No Waiver

Failure to enforce a provision does not waive the right to enforce it later.

29. Assignment

You may not assign these Terms without our written consent.

We may assign these Terms in connection with a merger, financing, restructuring, acquisition, or sale of the business.

30. Entire Agreement

These Terms and the policies incorporated by reference constitute the entire agreement between you and us concerning the Services and supersede prior agreements concerning the same subject.

31. Changes to These Terms

We may update these Terms for operational, legal, security, or regulatory reasons.

The revised version will be posted with an updated effective date. Material changes will be communicated where required by law.

Changes do not retroactively alter completed transactions unless legally permitted and properly disclosed.
